This Privacy Policy describes how Lymphira ("Lymphira," "we," "us," or "our") collects, uses, and discloses your personal information when you visit our website, browse our store, place an order, contact us, or otherwise interact with our online services (collectively, the "Services"). Our store is hosted on Shopify, which provides our underlying e-commerce infrastructure.

By using the Services, you acknowledge that you have read and understood this Privacy Policy. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, use, and disclosure of your personal information.

1. Personal Information We Collect

The categories of personal information we collect depend on how you interact with us. We may collect:

  1. Contact details - name, email address, phone number, shipping address, and billing address.
  2. Order and transaction information - items viewed, added to cart, wishlisted, purchased, returned, or exchanged; order history; shipping and tracking details.
  3. Payment information - payment card details and billing information. Card numbers are processed by Shopify Payments and other PCI-compliant payment processors; we do not store full payment card numbers on our systems.
  4. Account information - username, hashed password, saved addresses, communication preferences, and account settings (if you create an account).
  5. Communications - messages, product reviews, customer-service inquiries, and feedback you send to us.
  6. Wellness-related preferences you voluntarily share - for example, when you ask a question about a product or leave a review. Lymphira products are wellness products and are not intended to diagnose, treat, cure, or prevent any disease. Please do not send us medical records or diagnostic information.
  7. Device and usage information - IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, time spent, clicks, and similar interaction data.

2. How We Collect Personal Information

We collect personal information:

  • Directly from you when you place an order, create an account, subscribe to our newsletter, leave a review, or contact customer support.
  • Automatically through cookies, pixels, SDKs, and similar technologies when you use the Services.
  • From service providers and partners, including Shopify, payment processors, shipping carriers, analytics providers, and advertising platforms such as Meta (Facebook and Instagram) and Google.

3. How We Use Personal Information

We use your personal information to:

  • Process and fulfill your orders, including shipping, returns, exchanges, and refunds.
  • Create, maintain, and secure your account.
  • Communicate with you about orders, customer-service inquiries, and account matters.
  • Send marketing emails and text messages where you have consented or as otherwise permitted by law.
  • Personalize your experience, remember your preferences, and recommend products.
  • Show you relevant advertisements on Meta, Google, and other platforms - including retargeting based on items you have viewed or added to your cart.
  • Measure and improve the performance of our marketing and Services.
  • Detect, prevent, and respond to fraud, abuse, and security incidents.
  • Comply with legal obligations and enforce our terms.

4. How We Share Personal Information

We share personal information only as described below:

Service providers. We share information with vendors that perform services on our behalf - including Shopify (e-commerce platform and hosting), payment processors, shipping and fulfillment partners, customer-support tools, email and SMS providers, analytics services, and cloud-storage providers - under contracts that limit how they may use your information.

Advertising partners (Meta and Google). We share certain information with Meta Platforms, Inc. (Facebook, Instagram) and Google LLC for advertising and measurement purposes, including through tools such as the Meta Pixel, the Meta Conversions API, Google Ads tags, and Google Analytics. This may include hashed identifiers (such as hashed email addresses), device identifiers, and information about actions you take on the Services. These partners may combine this information with data they already hold. You can manage many of these uses through the controls described in Sections 6 and 7.

Shopify enhanced features. Shopify may use information about your interactions with our store, along with interactions with other Shopify-powered merchants, to provide features such as Shop Pay, fraud prevention, and personalized recommendations. Legal and safety. We may disclose personal information when we reasonably believe it is necessary to comply with applicable law, respond to valid legal process (such as subpoenas or court orders), protect the rights, property, or safety of Lymphira, our customers, or others, or investigate potential violations of our policies.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction.

With your direction or consent. When you ask us to share information with a third party, or when you publicly post information (such as a product review).

We do not sell your personal information for money. However, some of the advertising-related sharing described above may qualify as a "sale" or "sharing" of personal information under certain US state privacy laws. See Section 7 for your opt-out rights.

5. Wellness Products and Health Information

Lymphira sells lymphatic-wellness products. We are not a healthcare provider, and the Services are not a substitute for professional medical advice. We do not knowingly collect protected health information subject to HIPAA. Please do not send us medical records, diagnoses, or other sensitive health information. Any general wellness information you voluntarily share with us (for example, in a customer-service message or product review) is handled under this Privacy Policy.

6. Cookies and Tracking Technologies

We and our partners use cookies, pixels, SDKs, local storage, and similar technologies to operate the Services, remember your preferences, analyze traffic, and deliver advertising. The technologies we use include:

  • Strictly necessary cookies - required for cart, checkout, login, and security.
  • Analytics cookies - such as Google Analytics, to understand how the Services are used.
  • Advertising cookies and pixels - such as the Meta Pixel and Google Ads tags, used to measure ad performance and show you relevant ads on Meta and Google properties and across the web.

7. Your US Privacy Rights

Depending on the state where you live, you may have some or all of the following rights regarding your personal information:

  • Right to know / access the categories and specific pieces of personal information we hold about you.
  • Right to delete personal information we maintain about you.
  • Right to correct inaccurate personal information.
  • Right to data portability - receive a copy of your information in a portable format.
  • Right to opt out of "sale," "sharing," or targeted advertising.
  • Right to limit the use of sensitive personal information where applicable.
  • Right to non-discrimination for exercising your rights.

California residents may opt out of the sale or sharing of personal information by emailing the address above or by enabling the Global Privacy Control signal in their browser.

If we deny your request, you may have the right to appeal by replying to our response. If your appeal is denied, you may contact your state attorney general.

8. Marketing Communications

You can opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email. You can opt out of marketing text messages by replying STOP to any message. Even if you opt out, we may still send you transactional messages about your orders or account.

9. Children's Privacy

The Services are not directed to, and we do not knowingly collect personal information from, children under 16. If you believe a child has provided us with personal information, please contact us at info@lymphira.com and we will take appropriate steps to delete it. As of the Last updated date above, we do not have actual knowledge that we sell or share personal information of consumers under 16 years of age.

10. Data Retention

We retain personal information for as long as we need it to provide the Services and for the legitimate business purposes described in this Privacy Policy - including to fulfill orders, maintain your account, comply with tax, accounting, and other legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we delete or de-identify it.

11. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls, and reliance on PCI-compliant payment processors. No method of transmission or storage is fully secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

12. Third-Party Links

The Services may contain links to third-party websites and services. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party site you visit.

13. International Users

The Services are intended for users in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data-protection laws may differ from those of your country.

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will post the updated policy on this page and revise the "Last updated" date. Material changes will be communicated as required by applicable law.
